VHH-MMSI: Terms of Use and Conditions of Use

General

These Terms of Use govern the use and application of the online system “Visual History of the Holocaust Media Management and Search Infrastructure (VHH-MMSI)” (hereinafter referred to as “web platform”), available at https://www.vhh-mmsi.eu.

They form an integral part of the user agreement concluded between the user and the operator of the web platform during the registration process.

Where personal designations are used in the following in the masculine form only, they refer to all legally recognized genders in the same way. When applying the designation to specific natural persons, the gender-specific form must be used.

Conclusion of the user agreement: Registration and creation of the user account

By completing the registration form (registration), the user creates their personal user account, which allows them to access the web platform after confirming the registration email sent to them. Upon completion of the registration, a corresponding user agreement is concluded. These terms of use form an integral part of this agreement.

User account

The user account manages the user’s data and provides access to the web platform for users. After receiving valid access, the user can access the information and functions on the web platform in accordance with their authorisation.

Entries made by the user on the web platform are subject to all legal regulations applicable at the operator’s registered office. The respective terms of use apply to the use of the web platform.

Duties of care

The user must ensure that they are authorized to carry out activities within the scope of the user account or when using the web platform, in particular if this is done on behalf of third parties.

All data entered must be checked by the user for completeness and accuracy before release. The user is also obliged to keep the information in the user account up to date so that contact can be made.

The user is required to use the features offered on the web platform, such as annotations, bookmarks, and vocabularies, carefully and thoughtfully. The user is aware that misuse can lead to immediate termination and cancellation of the user agreement.

It is pointed out that the user is solely responsible and liable for any illegal entries and, in particular, any statements relevant under criminal law that they make, for example in annotations, bookmarks, or vocabularies on the web platform. In such cases, the user shall indemnify and hold LBG harmless.

The user must also ensure that no harmful influences are exerted on the technical equipment (hardware, software) of the user account or on the web platform from devices used to access the user account or the web platform. This includes, in particular, the user’s obligation to ensure that the user’s technical equipment is equipped with up-to-date and state-of-the-art cyber security solutions, such as, in particular, up-to-date systems for defending against viruses and malware, firewalls, or other security solutions.

The user is obliged to keep his personal access data confidential.
Any disclosure of access data to third parties is prohibited.

Users may be blocked at any time and excluded from access to and participation in the web platform if misuse is suspected. This applies in particular to users who take actions aimed at disrupting the proper functioning of the system or data transmissions, violate other security requirements, duties of care or confidentiality obligations, or violate legal provisions.

Please note that all content on the web platform that is not otherwise marked is subject to copyright. The user acknowledges that the existing copyrights of the project partners and content providers remain unaffected by the registration and use of the web platform and that no rights can be derived from this.

Usage times and support

The web platform is generally available 24 hours a day, 7 days a week.
Restrictions on use may be necessary for maintenance purposes or to implement technical enhancements.
These will be announced in good time wherever possible. Further information on the availability of the web platform will be published on the web platform accordingly.

Termination of the user agreement

The user agreement can be terminated at any time by sending a written notice of termination by email to support@lbg.ac.at. The user account will then be deactivated or deleted. Any annotations, bookmarks, or vocabularies created on the web platform will be deleted or anonymized, unless otherwise agreed.

Warranty and liability

Any warranty and any claims for damages are excluded by the Ludwig Boltzmann Gesellschaft (“LBG”) to the extent permitted by law.
LBG therefore accepts no warranty or liability for the topicality, correctness, completeness, and availability of the user account or the web platform. In particular, no legal claims can be established arising from the use or non-use of the information retrieved and the offer on the web platform.

LBG also accepts no liability for any damage that may arise for a user as a result of another, unauthorized user carrying out activities on the web platform in their name.

LBG expressly reserves the right to change or supplement individual areas or the entire offering on the web platform at any time without prior notice, and to temporarily or permanently suspend access to the web platform. All services provided by the web platform are offered subject to availability. LBG will of course endeavor to keep the web platform accessible at all times in an appropriate form.

Any maintenance work, further development of the web platform, or other disruptions may restrict the possibilities of use or temporarily interrupt access to the web platform. This may also result in data loss under certain circumstances. The user acknowledges this and agrees that no claims for compensation can be derived or arise from this for the users affected.

The user is also liable for all consequences and disadvantages incurred by LBG as a result of the misuse or illegal use of the user account or the web platform or as a result of the user’s failure to comply with their other essential contractual obligations (such as, in particular, the obligation to keep their password secret).

The user shall indemnify LBG upon first request against any claims or demands by third parties asserted by them due to the violation of rights by the user or on the basis of content created by a user, including reasonable legal and attorney’s fees.

Furthermore, the user undertakes to support LBG in defending against such claims.

LBG accepts no liability or warranty for any applications provided by third parties (e.g., references and links) and their content. The respective provider is responsible for this. In particular, LBG is not liable for damages resulting from incorrect, non-functional, or delayed procedures or content, or for actions taken in reliance on the accuracy of the content.

Final provisions

LBG reserves the right to change these Terms of Use at any time. The current version is available on the web platform and becomes effective for the user upon continued use of the user account or the web platform after the amended Terms of Use have come into effect.

Austrian law applies exclusively, excluding any conflicting provisions (e.g., IPRG) and the UN Convention on Contracts for the International Sale of Goods.

For any legal disputes between LBG and the user, the exclusive jurisdiction of the competent court in Vienna is agreed.

Should individual provisions of these Terms of Use be or become invalid, or should a loophole become apparent, this shall not affect the remaining provisions.

The contracting parties shall cooperate to find a provision that comes as close as possible to the invalid provision. The remaining Terms of Use shall remain unaffected.
